明尼蘇達州（Minnesota）修改指引，教師如不肯定LGBT身份和價值，便面臨被吊銷牌照的危機。這一舉動是頂著DEI*政策中「包容」（inclusivity）的名號而來。有研究宗教自由的學者評論，明尼蘇達州這新規定可能侵犯《美利堅合眾國憲法》第一修正案（First Amendment to the United States Constitution）中賦予教師的權利。

事情起源
事源於明尼蘇達州官方Minnesota’s Professional Educator Licensing and Standards Board (PELSB)在2022年12月草擬新教學準則，名為“Standard of Effective Practice”。這指引要求教師「營造一個安全環境，讓學生能探索自己的身份」，這身份包括「性取向」。這環境應該能讓學生身份「符合歷史和社會處境，並受到肯定」。還有，根據新指引，學生身份（包括性取向）的元素應該融入學習環境中，以致學生受鼓舞以「整全自我」去學習。[1]
再者，新教師準則要求教師在教學上著重歧視交叉性（intersectionality）。歧視交叉性是一個理論框架，用於理解由多個個人身份的組合所引起的特殊歧視和壓迫。這些方面的例子包括心理性別、種姓、生理性別、種族、階級、宗教、殘疾、外貌，以及身高。根據新教學準則，教師必須幫助學生「學習存在於各社群的交叉性、權力、優勢和壓迫」，還須採取「反種族歧視」教學方法。[2]
根據Fox News報導，民主黨副總統候選人兼明尼蘇達州州長Tim Walz親自挑選及任命PELSB成員。PELSB的全部成員（13名）都是他引薦的。在這些左翼成員的積極推動下，由今年（2025年）7月起，現正任職或考慮任職的老師如想保住教學牌照，便要配合明尼蘇達州新訂的指令，支持LGBT，因為新的指令將會在今年7月生效。
新指引涉違反教師憲法權利及宗教自由
最高法院頂尖訴訟小組擔心新準則損害宗教自由。原因由Alliance Defending Freedom 大律師Tyson Langhofer道出：「一般而言，州有權決定公立學校的課程內容。這意味著，州政府可以吩咐公立學校教師教授某一類意識形態、政治概念或宗教的理論。」他繼續道：「儘管政府本應不能逼迫教師言行一致地認同某信念或意識形態，新的教學準則就是在逼迫教師這樣做，而不是只要求教師教某種課程。這準則是在要求教師作違背自己意願的行為，是侵犯了他們的憲法權利。」明尼蘇達州組織the American Experiment的教育政策研究員兼前公立學校教師Catrin Wigfall擔心，新教學準則會令有志加入教師行列的人士卻步，加劇教師荒的問題，因為他們怕要為保住工作而被逼向學生灌輸他們不認同的意識形態。
大律師Langhofer認為可以運用《美利堅合眾國憲法》第一修正案去保護明尼蘇達州教師的權利，抵抗這新準則。他說：「如果教師被逼宣揚自己不同意的概念，或是被逼參與違背自己宗教信仰的教學活動，他們可以指出自己基本的行使自由權被侵犯了。但詳情要再看這新教學準則如何實行。」
大律師Langhofer的顧客對《美利堅合眾國憲法》第一修正案和宗教自由應該很熟悉，因為Langhofer就是用這兩點來為顧客辯護。例如Langhofer曾為一位遭跨性別人士控告的教授辯護，最後勝訴。這位教授就是因不肯以跨性別代名詞*（he/she/they）稱呼一位學生而被控。這件事件獲The Fix報導。

總結
新聞媒體The Fix曾就教師準則所觸及的言論自由、宗教自由問題，嘗試聯絡明尼蘇達州教育局及 幾間主要大學（North Central University, Bethel University, 和Crown College），詢問他們在新準則下的定位和立場。但他們沒有回覆。
明尼蘇達州政府如此著重性別與身份教育，但與此同時學生的學習能力問題卻未得到重視。根據明尼蘇達州政府官方在2022年發表的報告，州內只有12%的八年級公共黑人學校的學生精通閱讀，八年級學生的閱讀能力分數平均只比全國學生高1分。而現今的明尼蘇達州學生的測驗成績也比1998年的差。當局不積極想辦法改善學生的學習能力，反而將焦點放在學生的性別和身份認同問題。到底這樣是否真的對學生好呢？
